Colorado Tax Updates: Marijuana, Property, and Sales & Use

Colorado has made several updates to its tax regulations, impacting marijuana, property, and sales & use taxes.

Marijuana:

Colorado Cigarette, Alcohol & Miscellaneous Taxes—Colorado amends marijuana regulations.

The Marijuana Enforcement Division of the Colorado Department of Revenue has amended regulations (1 CCR 212-3, effective 12/04/2024) relating to Colorado marijuana rules. The amendments implement legislation passed during the 2024 legislative session intended to streamline marijuana regulation. The changes include removal of requirements to apply for approval before modifying licensed premises, the extension of all license terms from one year to two years, and new and revised rules to continue the Division's work to revise existing regulations for improved agency and licensee operations.

Colorado Property Tax—Colorado issues forms for claiming the qualified senior primary residence classification.

The qualified senior primary residence classification, created by L. 2024, S111 (reported in State Tax Update, 05/17/2024), requires a property owner to complete an application and submit it to the assessor's office in which the residence is located. The Division of Property Taxation created the following forms for this program: Qualified Senior Primary Residence Classification Application; Qualified Senior Primary Residence Classification Instructions; and Qualified Senior Primary Residence Classification Notice. Colorado Property Tax—Colorado updates eligibility documents for the veteran with disability exemption.

The Colorado Division of Property Taxation has updated the eligibility documents for the veteran with a disability exemption, following passage of Constitutional Amendment G at the November 5 election, which implements L. 2023, H1052 (reported in State Tax Update, 05/02/2023). The law extends the eligibility for the property tax exemption for veterans with a disability to include a veteran who does not have a service-connected disability rated as a 100% permanent disability but does have individual unemployability status. Veterans determined to meet the unemployability status must complete an application and submit it to the assessor's office in which the residence is located. The following forms have been updated for the exemption: Veteran with a Disability Application; Veteran with a Disability Instruction; and Veteran with a Disability Notice.
