Delaware Minimum Wage Increase
- Effective Date: January 1, 2025
- New Minimum Wage: Increases from 13.25∗∗to∗∗13.25∗∗to∗∗15.00 per hour.
- Tipped Employees: Minimum cash wage remains at $2.23 per hour.
- Tip Regulations:
- Employers cannot take or retain tips except as required by law.
- Tip pooling is allowed, up to 15% of actual tips received.
Upcoming Paid Family and Medical Leave (PFML) Program
- Employer Participation: Required for employers with 10 or more employees.
- Payroll Deductions: Begin on January 1, 2025, if employees contribute.
- First Contribution Due Date: April 1, 2025.
- Claim Applications: Employees can start submitting claims for payment beginning January 1, 2026.

Delaware Minimum Wage Increasing to $15 Per Hour in 2025
The Delaware Department of Labor announced that the minimum wage rate is increasing from $13.25 per hour to $15.00 per hour on January 1, 2025. This is part of an incremental increase that began in 2015. The minimum cash wage for tipped employees is $2.23 per hour. Employers cannot take or retain tips except as required by law. Tip pooling is allowed under certain circumstances, up to 15% of actual tips received. See Payroll Guide ¶19,060.
Delaware Upcoming Paid Leave Program Deadlines
As the implementation of Delaware's Paid Family and Medical Leave (PFML) program approaches, employers should be aware of some important deadlines and requirements. Employers with 10 or more employees are generally required to participate in the program, with different coverage levels based on company size. Payroll deductions for participating employers will begin on January 1, 2025, if employees contribute to the cost. The first due date for PFML contributions is April 1, 2025. Beginning January 1, 2026, employees can start to submit claim applications for payment.
